PRE-LITIGATION – The Clark & Trevithick Litigation Team counsels clients on emerging disputes with a view to avoiding litigation where possible. This includes informal negotiations, mediations, and behind-the-scenes advice. Clark & Trevithick’s litigators assist in finding, interviewing, and coordinating work with local counsel in geographic areas where the firm does not practice.
CIVIL LITIGATION – The Clark & Trevithick Litigation Team handles all phases of jury and non-jury trials in state and federal courts throughout California. They handle important preliminary relief procedures such as writs of possession, writs of attachment, and injunctions. They prepare necessary discovery, law and motion matters, and dispositive motions such as motions for summary judgment. The team is also highly skilled in pretrial settlement procedures, including mediation and settlement conferences.
BUSINESS LITIGATION – The Clark & Trevithick Litigation Team excels in disputes involving unfair competition, contracts, general commercial matters, professional liability claims against accountants & lawyers, employment relations, real estate, environmental matters, and intellectual property.
EMPLOYMENT LITIGATION – The firm is highly qualified to handle employment disputes at all stages including wrongful termination, discrimination, harassment, retaliation, and wage and hour claims. Its lawyers have appeared in administrative proceedings before such public agencies as the Fair Employment & Housing Commission, the Equal Employment Opportunity Commission, and Employment Development Department.
CREDITORS’ RIGHT & REMEDIES – Clark & Trevithick has attorneys with extensive experience in all aspects of bankruptcy and insolvency matters, including debtor/creditors’ rights and remedies. Clients frequently seek our advice to ensure their credit practices are prudent.
Our creditors’ rights practice focuses on providing our creditor clients the maximum protection permitted by law through the use of various security arrangements and interests. In the event of litigation, Clark & Trevithick’s lawyers quickly and economically prepare the necessary pleadings and pursue prejudgment remedies, including attachments and writs of possession.
We protect the secured and unsecured claims of financial institutions. We can pursue litigation while concurrently negotiating beneficial restructuring or debt workouts.
We also represent debtors and borrowers relating to various financial problems. We seek solutions without formal court proceedings but on occasion will represent debtors in formal Chapter 11 proceedings.
WHITE COLLAR CRIMINAL DEFENSE – Clark & Trevithick has extensive experience in representing individuals and corporations in federal and state criminal investigations and proceedings. This experience ranges from conducting internal investigations on behalf of companies and organizations to post-indictment representation at trial.
REGULATORY ENFORCEMENT – Clark & Trevithick has successfully represented corporations and individuals in investigations and proceedings brought by the Securities and Exchange Commission, State Boards of Accountancy, the Federal Trade Commission, the Federal Elections Commission, the Defense Logistics Agency, the California Fair Political Practices Commission, and the California Department of Insurance, among others.
INSURANCE – Clark & Trevithick represents insurance companies, prominent self-insured entities and insureds on tort claim, construction defect, complex coverage general liability issues, and bad faith claims.
