11/13/2014 - Clark & Trevithick Real Estate attorney James S. Arico and Litigation attorney Stephen E. Hyam joined forces to assist their client in compelling the termination of a seven figure escrow related to the sale of commercial real property. After months of the buyer promising to close and all extensions on the close of escrow having ended, the seller engaged C&T to resolve the matter. With the seller ignoring C&Tís effort to reach a cooperative resolution, C&Tís prompt and efficient litigation resulted in the seller obtaining the termination it wanted. The property is back on the market and the seller is already in escrow with a new buyer. ďFirst and foremost....job well done!!! 9/30/2014 - Clark & Trevithick business litigation attorney David S. Olson, obtained an order for issuance of a writ of mandate compelling the manager of a California limited liability company to allow our client (a member of the LLC) to inspect books and records of the limited liability company. The manager vigorously opposed the petition for issuance of the writ of mandate, asserting myriad contentions as to why the inspection was improper, unnecessary, and should not be permitted. The Court ruled in our client’s favor, stating the manager’s refusal to allow the inspection “was and is entirely without justification.”

3/21/2014 - CASE DISMISSED FOR FAILURE TO PROVE BREACH OF GUARANTY, FRAUD OR NEGLIGENCE. Joel A. Goldman has just completed a four day trial in Redwood City, California. The Firm represented an individual who is accused of breach of a personal guaranty, fraud and negligent misrepresentation. The trial lasted approximately four days and, after the Plaintiff rested, Joel made a motion pursuant to California Code of Civil Procedure 631.8 for Judgment on the ground that Plaintiff had failed to prove its case. The trial Judge granted our Client’s Motion and will enter a judgment of dismissal. Furthermore, not only did the Court find that our Client did not owe Plaintiff approximately $700,000, but will award him costs of suit and attorneys' fees.

1/24/2014 - C&T commercial litigation attorney Dana N. Levitt, who joined the firm in December 2013, was selected by the College of Commercial Arbitrators and the Los Angeles County Bar Association to chair a panel on "Trying the Arbitration Case." The program was presented at the January 23, 2014 CCA and LACBA co-sponsored event entitled: "What Lawyers Need to Know About Commercial Arbitration." Other lawyers on the panel include Mark A. Neubauer of Steptoe & Johnson, Ronald Cohen of Sidley Austin LLP and Howard B. Miller of Girardi Keese.
