11/24/09 C&T attorney Eric L. Dobberteen achieved a complete defense verdict for a shopping center owner in a dispute over a $425,000 contract that was part of a failed pollution remediation project. Plaintiffs alleged breach of contract, rights to additional "change order" amounts (almost doubling the cost of the original contract), interest and other causes of action. However, the court found for the client on all counts. In addition, the court upheld the client's counterclaim alleging that it was the plaintiff who breached the contract, upheld the client's claim for damages and will be awarding substantial attorneys' fees to the client.
